These are the binding terms for using Influspot to build, grow, and auto-publish an AI persona. By creating an account or using the service, you agree to these terms. Please read them together with our Privacy Policy.

Operator & definitions

Influspot is operated by OUTSI sp. z o.o. (OUTSI Spółka z ograniczoną odpowiedzialnością), registered in Poland. Registered office: Kartuska 2, 83-334 Miechucino, Poland. KRS: 0000935494, NIP: 5892069190. These terms are governed by Polish law. In these terms, "Influspot", "we", "us", and "the service" mean OUTSI sp. z o.o. "User Content" means the persona reference material you upload and the photos and videos generated for you through the service.

Eligibility

You must be at least 18 years old to use Influspot — the service is strictly for adults. You must also have the legal authority to accept these terms, whether on your own behalf or on behalf of an entity you represent.

Acceptance & account

By creating an account or using the service, you agree to these terms. You must provide accurate information, keep your account credentials secure, and you are responsible for all activity that occurs under your account.

The service

Influspot lets you create safe-for-work (SFW) AI personas, generate photos and videos for them, and schedule and auto-publish that content to Instagram and TikTok through a third-party posting provider (Zernio).

Changes to the service

We may modify, suspend, add, or discontinue features of the service at any time. Where a change is material, we will give notice where doing so is lawful and reasonably practicable. Some changes may be necessary for security, legal, or operational reasons and may take effect without prior notice.

Acceptable use

Influspot is an SFW platform. The following rules are binding:

No sexual or sexually explicit content, and absolutely no child sexual abuse material (CSAM) of any kind.
No impersonation of real people without their consent.
No illegal, deceptive, hateful, harassing, or infringing content.
No attempts to bypass content safeguards or the credit system.

To be clear about scope: lingerie, swimwear, and suggestive-but-SFW content is allowed within the SFW register. The acceptable-use rules are not a requirement to limit content to "everyday clothing only" — they prohibit explicit, illegal, and abusive content, not tasteful suggestive imagery.

User Content & licence

You own your User Content — the persona references you upload and the photos and videos generated for you — subject to the terms of the underlying AI providers used to generate it. You grant Influspot a worldwide, non-exclusive licence to host, store, process, display, and auto-publish that content on your connected social accounts on your behalf, solely to operate the service for you.

You represent and warrant that you hold all rights necessary to any reference material you upload, including any rights to a person's likeness and any consent required to use it.

Third-party platforms & auto-posting

You are responsible for ensuring that any content you auto-post complies with Instagram's and TikTok's own terms and policies. Those platforms may remove content or suspend accounts at their own discretion, and Influspot is not liable for actions taken by them. Where a platform requires AI-generated content to be disclosed, you are responsible for making that disclosure.

AI-generated content & transparency

The photos and videos produced through the service are AI-generated synthetic media. In addition to your responsibility to make any platform-required AI disclosure (referenced in the prior section), you acknowledge that this output is artificially generated. This is provided for transparency in the context of the EU AI Act's transparency expectations for synthetic media.

Credits & billing

Plans grant credits that you spend on generation. Photos and videos cost different amounts of credits, and video costs more than photos. An active subscription is required to spend credits — credits lock and expire on cancellation and cannot be spent without an active subscription.

Subscriptions can be cancelled at any time, and you keep access until the end of the paid period. There is no refund for the current period or for credits that have already been spent. We will communicate any price changes in advance. Payments are processed by Stripe.

Consumer right of withdrawal

By purchasing and beginning to use a credit or starting a generation, you expressly consent to the immediate performance of the digital service and acknowledge that you lose your statutory 14-day right of withdrawal once generation begins or credits are spent. This consent is requested at the point of purchase.

Intellectual property

Influspot's own trademarks, software, and platform remain the property of OUTSI sp. z o.o. Nothing in these terms grants you any rights in them beyond the right to use the service in accordance with these terms.

Disclaimers & "as is"

The service is provided "as is". We do not guarantee any particular audience growth, follower counts, or monetization, and we do not guarantee that the service will be uninterrupted or error-free. AI-generated output may be imperfect or inaccurate.

Limitation of liability

To the maximum extent permitted by Polish and EU law, our liability arising out of or in connection with the service is limited. Nothing in these terms excludes or limits any mandatory consumer-protection rights that cannot be excluded under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless OUTSI sp. z o.o. against any third-party claims, liabilities, damages, losses, and costs (including reasonable legal fees) arising out of or related to your User Content, your use of the service, your breach of these terms, or your violation of any law or any third-party right (including likeness, privacy, and intellectual-property rights). This does not limit any mandatory consumer rights that cannot be excluded under applicable law.

Suspension & termination

We may suspend or terminate your account if you breach these terms, in particular the acceptable-use rules. Where appropriate and lawful, we will give notice, but serious breaches may result in immediate action.

Closing your account

You may close your account at any time by emailing a request to privacy@influspot.com (you may also use legal@influspot.com). On closure, your access to the service ends and your data is handled in accordance with the retention terms in the Privacy Policy.

DMCA / IP complaints

If you believe content on Influspot infringes your intellectual property rights, send a notice to dmca@influspot.com including: an identification of the copyrighted work or right claimed; identification of the allegedly infringing material and its URL or location; your contact details; a good-faith statement that the use is not authorised; and a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorised to act on their behalf. Accounts of repeat infringers may be terminated.

Reporting illegal content (EU Digital Services Act)

Anyone may report content they consider illegal under the EU Digital Services Act by emailing safety@influspot.com. The notice should include a sufficiently substantiated explanation of why the content is illegal, the exact location or URL of the content, the reporter's name and contact details (unless the report concerns CSAM, where contact details are not required), and a good-faith statement that the information is accurate. We review and act on valid notices and may remove or disable access to content found to be illegal.

Governing law & disputes

These terms are governed by Polish law. Any mandatory consumer venue and jurisdiction rights you have under applicable law are preserved and are not affected by this clause.

Changes to terms

We may update these terms from time to time. We will communicate material changes, and your continued use of the service after the effective date of an update constitutes acceptance of the updated terms.

General

If any provision of these terms is found unenforceable, the remaining provisions stay in full force. These terms together with the Privacy Policy are the entire agreement between you and us and supersede any prior understandings. Our failure to enforce a provision is not a waiver of it. We may assign or transfer these terms, for example in a corporate reorganisation or sale; you may not assign your rights without our prior written consent. We are not liable for any failure or delay caused by events beyond our reasonable control.
